Birds & Blooms Video Contest Rules

1. Eligibility: This Contest is open to U.S. residents 18 years of age or older at the time of entry. Employees of The Reader's Digest Association, Birds & Blooms, ("Sponsors"), Google, Inc. and Wingscape or their respective,affiliated or subsidiary companies, and their immediate family members and/or those living in the same household of such persons, are not eligible to enter Contest or to participate in the voting process. Contest is governed by the laws of the USA. All federal, state and local laws and regulations apply. Void where prohibited.
2. To Enter: The Contest begins accepting entries at 12 p.m. ET May 1, 2008 and stops accepting entries 11:59 p.m. ET on June 30, 2008. To enter, visit us online and follow the instructions listed under the Contest section. Please upload a video of backyard birds, squirrels and other great garden moments. Length, format specifications, and instructions regarding how to upload the video will be provided under the Contest section of our Web site. Entrants will be required to read the full rules and provide an entry, which will include: entrant's name, email address, video file, and caption. All submissions must be family friendly to be considered. Inappropriate humor will be rejected. Videos in which the picture is not viewable, or the audio is not clear will be rejected. The Submission must be the original work of the entrant and not previously aired or published. The Submission must not infringe the copyright, trademark, privacy, publicity or other intellectual property rights of any person or entity. All submissions must be received by 11:59 p.m. ET June 30, 2008. All entries become the property of Reader's Digest and will not be returned. We reserve the right to use your entry in all print and electronic media, and to edit it for brevity and clarity. By entering, entrants agree to be bound by these Official Rules and to posting of their entries on the Internet as described herein, in the event they are selected finalists.
3. Judging: Video finalists (10 to 50) will be selected by Birds & Blooms staff on or about July 1, 2008 based on the video's quality, personality and originality. All entries will be judged using the criteria stated above and weighted as follows: quality 50%, personality 25% and originality 25%. Judges decisions are final and binding in all matters related to this Contest. The Finalists selected by Birds & Blooms will be posted on its YouTube Web site. Members of the public will be invited to review and rank their favorite Finalists through the YouTube ranking system between 12 a.m. July 15, 2008 and 11:59 p.m. August 18, 2008. The five (5) Finalist submissions to receive the most votes during the public voting process will be the Grand Prize winners, subject to verification.
4. Prize(s): The five (5) Finalists will receive a BirdCam kit from our contest prize sponsor, Wingscapes. Kits include an outdoor, mountable camera with accessories, valued at approximately $300. All taxes, if any, are the sole responsibility of Grand Prize Winners. Reader's Digest will not be responsible for any loss, liability or damage arising out of the Grand Prize winner's acceptance or use of the prize. All prizes are guaranteed to be awarded.

Finalists and Grand Prize Winners: All Finalists will be required to agree to the use of their name and likeness and entry for promotional purposes (except where prohibited by law). Grand Prize Winners will be notified by email and regular mail within 4 weeks of selection and may be required to execute a Statement of Eligibility and Release and Payment Authorization within 30 days of prize notification attempt or Grand Prize Winner will be disqualified and prize may be awarded to an alternate winner. Return of prize or prize notification as undeliverable will result in disqualification and an alternate winner may be selected. Entry and/or acceptance of prize(s) constitutes permission for the Sponsors and their agencies (if any) to use the winner's name, submission, address (city and state) and/or likeness for advertising and trade purposes without further compensation or authorization, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, unless prohibited by law.

5. Conditions: Sponsors are not liable for any technical malfunctions of any telephone network or lines, computer internet system, servers or providers, computer equipment, software, failure of any email on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading/uploading any materials in this Contest, or other technical difficulties or failures or other errors of any kind. Sponsors are not responsible or liable for any injury or damage to an entrant's or third person's computer and/or its contents, related to or resulting from Contest. Sponsors reserve the right to terminate or modify the Contest at any time for any reason In such a circumstance, finalists and/or Grand Prize winners will be selected by Birds & Blooms based on entries received to date of termination. In the event that two similar entries are received, only the entry judged to best meet criteria as set by Birds & Blooms will be included in the final judging. Entrants agree to indemnify Sponsors, their affiliated and subsidiary companies from and against any and all claims and liabilities arising out of or in connection with this Contest. Any dispute regarding submission of online entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organizations (e.g. business, educational institute) that is responsible for assigning email addresses for the domain associated with the submitted email address. Birds & Blooms, in its sole discretion, reserves the right to disqualify any person tampering with the operation of the website or the entry process. The total number of contestants anticipated nationwide is 200.
